Texas DPS investigates possibility of filing criminal charges against El Paso Truck Driver

The Texas Department of Public Safety is investigating the possibility of charging El Paso, Texas commercial truck driver, Rodolfo “Rudy” Rios Calvillo, age 34, with criminal charges regarding the deaths of Maria del Carmen Montalvo, age 56, and her young daughter, Julissa Marie Montalvo, age 15, in a tragic auto accident on Tuesday, September 24, 2013, on U.S. Highway 277 North in Del Rio, Texas about one mile south of Ruben Chavira Elementary at the south entrance of the Del Rio city limits, reported Karen Gleason, a news reporter with the Del Rio News Herald.
Texas Department of Public Safety Officer Noe Fernandez told the Del Rio News-Herald reporter that while no criminal charges have been filed against Rios, DPS is thoroughly examining various documents Rios was required to carry onboard his tractor-trailer, including the bill of lading and his driver’s logs. Trooper Fernandez also told the Del Rio News-Herald reporter that DPS took a blood sample from Rios for the presence of alcohol or other drugs as required by law. Trooper Fernandez told the Del Rio News-Herald that DPS will conduct a thorough investigation of the tragic double fatality accident to determine whether any criminal charges should be filed against Rios. At the moment, no criminal charges have been filed against Rios.
In an exclusive interview with the Del Rio News-Herald, Rios stated that “I’m very sorry. I didn’t mean to do it. I will pray for them and for their family. I’m very, very, very sorry.”
The two Eagle Pass women, mother and daughter, were killed upon impact as Rios’ tractor-trailer allegedly veered left into the Montalvo’s family lane of travel. The Montalvos were traveling north on U.S. Highway 277 enroute to Del Rio, Texas for a dental appointment when Rios, who was traveling south on U.S. Highway 277 and delivering a load of tires to Laredo, Texas, suddenly veered into the Montalvo’s lane of travel causing the tragic double fatality accident.
The accident remains under investigation by the Texas Department of Public Safety.
