Texas Supreme Court Strikes City of Laredo Plastic Bag Ban Ordinance, Essentially Overruling Municipalities Similar Plastic Bag Ban Ordinances

A unanimous Texas Supreme Court ruled on Friday, June 22, 2018, that the City of Laredo, Texas plastic bag ban ordinance is preempted by state of Texas law concerning solid waste management, striking Laredo’s ordinance that banned plastic bags use within the city limits.
The Texas Supreme Court ruling essentially strikes down other Texas municipalities’ similar ordinances banning the use of plastic bags, including the City of Eagle Pass, Austin, Fort Stockton, Brownsville, and many others.
