State of Texas files petition of removal against Maverick County Commissioners Rodolfo “Rudy” Heredia and Eliaz Maldonado

The State of Texas, by and through Maverick County Attorney, Ricardo Ramos, filed a petition to remove from office Maverick County Commissioners Rodolfo “Rudy” Heredia and Eliaz Maldonado with the 293rd Judicial District Court of Maverick County, Texas on Friday, December 28, 2012.
The presiding judge of the 293rd Judicial District Court is the Honorable Cynthia Muniz.
The State of Texas petition for removal against Maverick County Commissioners Heredia (Precinct 2) and Maldonado (Precinct 1) is based on Chapter 87 of the Texas Local Government Code alleging that County Commissioners Heredia and Maldonado be removed from office because of unlawful behavior, acts of official misconduct, abuse of official capacity, and incompetency as a result of their federal grand jury indictments in late 2012 in two separate cases and other acts.
The State of Texas is requesting the 293rd Judicial District Court to temporarily suspend both County Commissioners Heredia and Maldonado without pay pending trial and appoint a qualified person to perform the duties of Maverick County Commissioners for Precincts 2 and 1, respectively; that County Commissioners Heredia and Maldonado be removed from their elected position as Maverick County Commissioners for Precincts 2 and 1, respectively; that County Commissioners Heredia and Maldonado be cited to appear and answer the State of Texas’ civil petition for removal from office; and that County Commissioners Heredia and Maldonado be ordered to pay the court costs and the Court grant the State of Texas such other relief to it may be entitled to at law or in equity.
This State of Texas petition of removal against County Commissioners Heredia and Maldonado comes after a large public outcry of Maverick County taxpayers for similar action and relief.
Maverick County Commisioner Rudy Heredia was denied bond by United States Magistrate Judge Collis White and remains detained at the Val Verde County Detention Center managed by the GEO Group in Del Rio, Texas, awaiting trial on his pending federal indictment charges.
Maverick County Commissioner Eliaz Maldonado was granted bond by United States Magistrate Judge Collis White and is out on bond pending his trial on the federal indictment charges.
