Heredia, Maldonado, and Flores federal cases reset; Moncada dismissed

Maverick County Commissioner Rodolfo “Rudy” Heredia and former Maverick County Commissioners Eliaz Maldonado and Cesar Flores pending federal criminal cases were all rescheduled for Docket Call and Rearraignment to future dates on Tuesday, April 9, 2013 by United States District Judge Alia Moses of the Western District of Texas, Del Rio Division, in Del Rio, Texas.
Temporarily suspended Maverick County Commissioner of Precinct 2 Rodolfo “Rudy” Heredia two pending federal criminal cases were reset for Docket Call and Rearraignment to Tuesday, May 14, 2013, and set for jury trial on Tuesday, May 21, 2013 before U.S. District Judge Alia Moses in Del Rio.
Former Maverick County Commissioner of Precinct 1 Eliaz Maldonado pending federal criminal case was also reset for Docket Call and Rearraignment to Tuesday, May 14, 2013, and set for jury selection on Tuesday, May 21, 2013 before U.S. District Judge Alia Moses in Del Rio.
Former Maverick County Commissioner of Precinct 4 Cesar Flores pending federal criminal case was also reset for Docket Call and Rearraignment to Tuesday, July 9, 2013 before U.S. District Judge Alia Moses in Del Rio.
In a surprise announcement in the federal criminal case against former Maverick County Purchasing Agent Juan Carlos Moncada, Assistant United States Attorney Michael Galdo filed a Motion to Dismiss the federal criminal indictment against Moncada because the federal government’s investigation revealed that there is insufficient evidence to prove beyond a reasonable doubt Moncada’s guilt of the charges. In a press release issued by United States Attorney Robert Pittman, on Tuesday, April 9, 2013, the federal government announced the dismissal of the three federal charges against Moncada because their investigation after the indictment showed that “IBC Bank advised that the specific checks used to pay for the forklift at issue did not utilize interstate wire facilities when they were deposited and therefore did not affect interstate commerce. Also after indictment, multiple witnesses exculpated Moncada and informed the Government that Moncada had no knowledge of the scheme to steal funds from the county.”
Moncada is dismissed and exculpated from the three charges previously filed against him by a federal grand jury.
