Maverick County Judge David R. Saucedo Response to Tax Rollback Petition
To whom it may concern,
Please find the below information in regards to action taken during last night’s Commissioners Court Meeting in reference to the Tax Rollback Petition. Attached is the Resolution that was approved by Commissioners Court.
- The Tax Rate as per Section 26.05 of the Tax Code was required to be adopted as of September 30, 2016. The Maverick County Commissioners Court rescinded their action of the adoption of the Tax Rate on September 29th therefore the adopted tax rate that is established as per 26.05 is September 30th which states specifically “The governing body of each taxing unit, before the later of September 30 or the 60th day after the date the certified appraisal roll is received by the taxing unit, shall adopt a tax rate for the current year”. The appraisal roll was received on July 15, 2016 so the later of the dates would be September 30th.
- The Tax Rate Rollback Petition is to be submitted “to the governing body on or before the 90th day after the date on which the governing body adopted the tax rate for the current year”. The adoption of the tax rate as per Section 26.05 of the Tax Code was September 30th. For the rollback, and any supplementation of the Petition (if petition is filed not later than 10 days before the deadline), would need to be submitted to the governing body on or before December 29th, 2016.
- The Maverick County Election Administrator reviewed the Petition and determined signatures to be invalid. There were individuals that were not registered, double signatures, dead, and obvious forgeries. There were individuals that wanted to withdraw their signature, as stated during the citizens to be heard segment of Commissioners Court, but those signatures were not invalidated.
