Maverick County Hospital District Board postpones appointment of new replacement Board of Director

The Maverick County Hospital District Board of Directors approved to postpone the appointment of a new repalcement Board of Director in a split 2 to 1 vote due to the lack of all Board members not being present at their Tuesday, October 6, 2015 meeting held in Eagle Pass, Texas.
The Maverick County Hospital District Board of Directors will have to wait until its next special or regular meeting to determine the appointment of a new replacement Board of Director due to Board Secretary and Treasurer Humberto Duran being absent at its October 6, 2015 meeting.
MCHD Board member Ronald Hixson motioned to table Agenda Item 5-B calling for discussion with possible action to identify and/or appoint potential replacement(s) for the MCHD Board of Directors vacancy due to Board Secretary and Treasurer Humberto Duran being absent from the meeting. The motion was seconded by Board member Juan Manuel Farias.
During discussion, Board member Ricardo E. Calderon noted that he opposed postponing the replacement of a MCHD Board of Director because all of the Board members had agreed to reschedule this agenda item from their September 29, 2015 meeting to this October 6, 2015 meeting and as long as a unanimous consent of the Board members present at the October 6th meeting would be sufficient to name a replacement Board member.
MCHD Legal Counsel Celeste Lira of Brin & Brin of San Antonio, Texas advised the Board that the state statute regarding the MCHD required that “the remaining Board members” unanimously agree on the replacement Board of Director the absence of Board Secretary and Treasurer Humberto Duran precluded unanimous consent by “the remaining Board members” as required by state statute.
Board members Ronald Hixson and Juan Manuel Farias voted in favor to table or postpone the decision to appoint the replacement Board member while Board member Ricardo E. Calderon opposed delaying the decision.
