Undocumented Alien Sentenced 75 Months in Prison for Assaulting Border Patrol Agent Near Eagle Pass

An undocumented alien who kicked a U.S. Border Patrol agent in the head during an encounter near Eagle Pass has been sentenced to six years and three months in federal prison.
Anastacio Hernandez-Hernandez, 45, a Mexican national, received the sentence October 7, 2026, from Chief U.S. District Judge Alia Moses in Del Rio, according to the Justice Department.
Court documents cited by federal prosecutors state that agents encountered Hernandez-Hernandez and two other individuals on September 4, 2024. All three fled after the agents identified themselves.
One agent tackled Hernandez-Hernandez, injuring his own right arm so severely that he could not bend it.
Hernandez-Hernandez also kicked the agent in the head before another agent helped handcuff him.An illegal reentry charge was filed October 2, 2024. A superseding indictment added assaulting, resisting or impeding a federal officer on February 5, 2025.
Hernandez-Hernandez pleaded guilty to that count May 19, 2025.
U.S. Attorney Justin R. Simmons said the defendant’s decision to resist and assault an agent led to consequences beyond the immigration charge.Border Patrol investigated the case. Assistant U.S.
Attorney Warsame Galaydh prosecuted it, and Assistant U.S. Attorney Brett Miner handled sentencing.
